These conditions of sale of subject to French law what ever the destination of the orders placed may be.
All orders imply acceptance of all present terms and conditions of sales without reservation on the part of the client, and that the client is aware of these terms and conditions..

All mentioned arrangements establish the general terms and conditions of on line sales of photographic works displayed on the site www.villesdenuit.com

Orders and choices of support models  :
The buyer is familiar with the fact that the images that represent the original works on the site www.villesdenuit.com are just an indication of the original. The light variations may appear between the image on the screen and the original photograph on paper. BdeE Prod can not be held responsible for minimal differences that may appear due to different presentation techniques and different gradings on different IT screens.

Tariffs:
All prices are indcated with all tax included (French VAT.) Any delivery costs are supplementary. Payment is only accepted in Euros. The pieces will be billed according to the tarriffs on the site www.villesdenuit.com at the moment the order is saved.
In the case of delivery to a country outside the EU and the DOM TOMs, any supplementary customs and taxes incurred on imports are at the clients own expense. It is therefore also the clients responsibility to check all possible methods of import of the photographic works to the country of delivery.In the case of refusal of payment of aforementioned taxes the cost of returning the product as well as any supplementary taxes are at the expense of the client.
The aforementioned rights and costs may under no circumstances be chargesd to BdeE Prod.

Payment :
Safe and secure payment can be made by card. We accept most major credit cards, visa and Mastercard. Customer bank details are encrypted (SSL technology, secure socket, Layer.) Customer bank details are always kept confidential and can never be intercepted. PayPal protects card details and payment information and is one of the best and most secure payment methods in the market and protects against fraud. When paying by PayPal, your details are kept secure and confidential and are never given to any third parties. Payment details are not distributed to BdeE Prod, owner of www.villesdenuit.com.

Intellectual property rights :
The transfer of property resulting from payment of the asking price is limited exclusively to material support of the work, which is to say that the work is sent to the buyer by BdeE Prod.  The buyer does not have any intellectual property right to the photographs. By consequence, the buyer may only use the work in a strictly private manner.
In all cases, all reproduction, representation, use, changing andmodification incorporation, translation commercial usage, partial or in full in any procedure and in any format (paper, digital…) is prohibited without the written consent of the author and of BdeE Prod, the responsible director apart from exceptions in article L.122.5 of the intellectual property code, that are always subject to counterfeit law at the right of the owner and/ or the editions and models or marks punishable by two years imprisonment and a fine of 152 449,02 Euros.

Availibility:
The editions are availible for sale as long as they are on display on the site www.villesdenuit.com.

Delays and delivery :
BdeE.prob gives their best work possible in the delivery of products ordered, with an average delivery time of 3 weeks, excluding any transport delays. In the case of extra delays, BdeE Prod will inform the client of the expected date of delivery.
The delivery will be carried out during working hours, to the address indicated on the order and validated at the time of purchase. All redeliveries due to errors in the given address will be at the expense of the client.  
Upon receival of the delivery, it is the responsibility of the client to verify the condition the the photographs and not to accept them should they be damaged upon arrival. Should this be the case, as well as sending the original manuscripts, they must fill in a «general faults» form by the billing issuer or the is sueing post office.
In the case of refusal of delivery, the client must ask the issuing post office to return the parcel to BdeE Prod, and the parcel must be accompanied with an official despoliation report, (report 170) and the client must also keep a copy of this document. This document should also be sent toBdeE Prod, in order to ensure the proper remuneration procedures.
The client must also inform BdeE about the procedure by mail, in order to recieve either a full reimbursement or a new edition of the work after sending the damaged product back. In the case of a visible defect or a problem with delivery, All redistribution of goods must be subject to a formal agreement between BdeE Prod and the client.  
This agreement allows them to obtain the replacement edition(s) at the exclusion of other indemnities and or damages and interest.
The goods must be returned in good state and in their original packaging. No indemnities may be reclaimed for late deliveries or for impaired editions.

Garantie and rights to retraction :
Under article L121-20 the consumer code, the client has the legal right to a seven day delay after delivery to act on the exchange or reimbursement of a product.
This short delay is counted from the date of recieval of the works by the client. – The return of the works is at the risk and expense of the client The proof of return also comes back to the client. The scratched, bent or generally damaged works will not be reimbursed.  In the case that the product is returned in perfect condition in its original packaging, the reimbursement will be made by cheque within three weeks following the recieval of the piec e at the address listed above.

Major Force :
Under Article 1148 of the civil code, BdeE Prod can not be held responsible in the carrying out of an order if lateness or complete missing of a product as aresult of major force (Cass-Ass.pl, 14/4/2006: unstoppable and unforseeable events.)

Nominative information :
All the clients personal details are only shared strictly with BdeE Prod. In accordance with information technology law and freedom of information acts, from the 6ht January 1978, the client has the right to access, correction and cancellation of personal details concerning a puchase at any time.

Settlement of ligitation :
In the hypothetical basis where litigation would be a result of a present contractual agreement, the involved parties should find a friendly solution before any judicial action must be taken.  By default, litigation will be the competence of a tribunal in Angers.
